GENERAL TERMS AND CONDITIONS OF SALE

These sales conditions are concluded on the one hand by the company MNS CORP, a limited liability company registered with the RCS Paris under number 95309256600017, whose registered office is located in Paris, and on the other hand by any natural or legal person wishing to make a purchase via the website gelwatergun.com, hereinafter referred to as "the buyer" or "the client."

Article 1. Purpose

These sales conditions aim to define the contractual relationships between MNS CORP and the buyer, as well as the conditions applicable to any purchase made through the website gelwatergun.com, hereinafter referred to as "the Site."

The acquisition of a product through this site implies the buyer's unconditional acceptance of these terms of sale, which the buyer acknowledges having read prior to placing their order.

To this effect, the buyer confirms acceptance of all the general terms and conditions of sale when they check the box "I accept" at the time of placing their order.

Before any transaction, the buyer declares on the one hand that the purchase of products on the site gelwatergun.com is not directly related to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity allowing them to commit to these general terms and conditions of sale.

Article 2. Products

Article 3. Prices

Attention, if the buyer places two (or more) distinct orders for the same delivery location on the same day, it will not be possible to combine them and shipping fees will be charged for each of them.

In metropolitan England, for any order of 80 euros including VAT or more, delivery charges are waived; for any order under 80 euros including VAT, a flat fee for delivery costs will be charged to the buyer based on the weight of the package, including packaging.

For any order outside England, a shipping fee is charged to the buyer based on the weight of the package, including packaging.

MNS CORP delivers in the following geographic areas:

• Metropolitan England
• The European countries fully allowing the entry of products into their territory, with the exception of countries other than Belgium.

Article 4. Order

Two possibilities are available to the buyer:

1. Order as a guest without creating a customer account on the Site.
2. Order by first creating a customer account on the Site.

Order as a guest

The buyer can choose to place an order without creating an account on the Site, as a guest.

He will not provide personal information when adding products to his cart.

Nevertheless, once the cart is validated, he will need to provide personal data to enable the delivery of the purchased items, their payment, and the sending of the order confirmation, payment, and invoice.

Order with customer account

Before placing an order, the buyer can create an account on the site gelwatergun.com. The account creation section is accessible directly from the menu bar.

The buyer can create an account on the Site by clicking on the title "My account" or the designated icon.

Once on the dedicated page, he will need to provide an email address, a password, and a delivery address.

The buyer will be able to find their orders on their account and fill in additional information (optional).

The buyer assures MNS CORP that they hold the necessary authorizations to use the payment method they have chosen to settle their order at the time of placing it.

For each order, the buyer must provide and verify the billing address and the delivery address, then proceed to choose their delivery and payment method. An order number will be assigned to the buyer as soon as they have paid for their order.

Only the confirmation of payment definitively validates the order and contractually binds MNS CORP to the buyer.

The buyer will receive their invoice in electronic format by email.

The buyer will be charged the amount of their order after payment on the Site, without waiting for the shipment of the ordered products.

If the buyer has created an account on the Site, the invoice will be available on the Site in the buyer's account.

Any order that appears abnormal, particularly due to its amount, volume, or frequency, may be suspended and may, if necessary, justify the suspension and/or closure of the buyer's account on the Site.

Article 5 - Payment Terms

MNS CORP offers the buyer to order and pay for their products by credit card.

All data entered during payment by Credit Card is immediately encrypted using the SSL protocol and stored on the secure server of the banking institution. No confidential payment data is stored by MNS CORP. This information is accessible only to our banking partner. At no time does MNS CORP have access to the buyer's banking data.

In the event of total or partial non-payment of any amount due by the buyer, in the event of a payment incident, or in the event of fraud or attempted fraud related to the use of the Site, including in connection with previous orders, MNS CORP reserves the right to suspend or cancel any execution of an order and/or delivery, regardless of its nature and level of execution.

The confirmation of an order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and waiver of the right to invoke its own purchasing conditions. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, MNS CORP will communicate the confirmation of the registration of their order by email.

Article 5. Retention of title

MNS CORP retains full and complete ownership of the products sold until full payment of the price, including principal, fees, and taxes.

Article 6. Withdrawal

Under Article L221-18 and following of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return shipping costs which remain the responsibility of the buyer.

To exercise their right of withdrawal, the buyer must inform MNS CORP of their decision to withdraw through an unambiguous statement, for example, a letter sent by post or by email.

The buyer must return or restore the products to MNS CORP without excessive delay and, in any case, no later than fourteen days after having communicated their decision to withdraw.

Products must be returned or refunded in their original packaging, intact, accompanied by all possible accessories, user manuals, and documentation, to the following address:

Return shipping costs are the sole responsibility of the buyer, unless MNS CORP made an error in the delivery or if the product is defective. In this case, MNS CORP will reimburse the return shipping costs upon presentation of proof.

In accordance with the applicable regulations, the buyer's refund will be processed within fourteen days from the receipt of the returned products or the proof of their shipment, depending on the payment method used at the time of the order.

Article 7. Delivery

The products are delivered to the delivery address specified at the time of the order.

The delivery time is indicated on the site at the time of placing the order. It may vary depending on product availability and the delivery location.

In case of shipping delay, an email will be sent to the buyer to inform them of a possible impact on the delivery time that was indicated to them.

The risks related to transport are borne by MNS CORP until the product is delivered to the buyer. In accordance with law no. 78-17 of January 6, 1978, as amended, relating to data processing, files, and freedoms, the buyer has the right to access, rectify, delete, and oppose the personal data concerning them.

Article 11. Liability

MNS CORP cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the buyer's responsibility to check with local authorities the possibilities of importing or using the products or services they intend to order.

Article 12. Applicable Law - Disputes

These general terms and conditions of sale are subject to French law.

In case of dispute, an amicable solution will be sought before any legal action. Failing that, the French courts will have sole jurisdiction.
